Termination and Retiring Employee

During the plan year, a terminating employee is covered until the last day of the month:

  • In which employment ends (interim employees are in this category)

  • In which suspension without pay occurs

  • In which employee ceases being in a benefit-eligible position

  • In which employee retires

Exceptions

  • If an employee qualifies for the Family Medical Leave Act (FMLA), coverage will end the last day of the month in which eligibility for FMLA ends, as long as required employee premiums are paid.

  • If an employee is an instructional employee and the employee works through the last day of the contract period, coverage ends the last day of August of the same year, as long as required employee premiums are paid.

  • If an employee is a non-instructional employee and eligible for multi-checks, coverage ends the last day of the month for which the employee has had benefit deductions taken, as long as required employee premiums are paid.

Termination followed by rehire within 30 calendar days:

If you terminate employment and are rehired within 30 calendar days or less after termination, we will, by default re-enroll you into the benefit plans that were in place prior to the termination (including your Health Care FSA), unless otherwise provided by law. You will have access to the Health Care FSA balance up to the full annual limit for expenses incurred after you return (reduced by prior reimbursement).

The employee will be subject to the MCSD benefit waiting period. New benefit elections must be made through the New Hire module in Bentek during the applicable benefit waiting period.
